1. About this Financial Services Guide

1.1 This Financial Services Guide (FSG) is provided by Trstport Pty Ltd (ACN 687 946 881), trading as Trustport (Trustport, we, our or us), in our capacity as an authorised representative of MSC Advisory Pty Ltd (AFSL 480649) (MSC Advisory).

1.2 This FSG is designed to help you decide whether to use the financial services we provide. It explains:

  • (a) who we are and how to contact us;
  • (b) the financial services we are authorised to provide and the financial products those services relate to;
  • (c) how we and MSC Advisory are remunerated;
  • (d) any associations or relationships that could influence the services we provide;
  • (e) how we handle complaints and the compensation arrangements we have in place; and
  • (f) how we collect and use your personal information.

1.3 You may also receive other documents from us in addition to this FSG, including the Platform Agreement, the Escrow Deed and our Privacy Policy.

2. About Trustport

2.1 We provide an escrow and account service for parties to real estate transactions. Through our online platform, we hold deposit funds and other transaction funds on bare trust for buyers and vendors until the funds are released in accordance with the parties' instructions or a court order.

2.2 In providing this service, we may apply for, hold and operate basic deposit products and non-cash payment products on behalf of our customers. Where we do, we act as an authorised representative of MSC Advisory under their Australian Financial Services Licence.

3. About MSC Advisory

3.1 MSC Advisory Pty Ltd (ACN 607 459 441) holds Australian Financial Services Licence No. 480649. MSC Advisory has authorised us to provide the financial services described in this FSG on its behalf.

3.2 MSC Advisory is responsible for the financial services we provide under MSC Advisory's licence.

4. The financial services we are authorised to provide

4.1 We are authorised by MSC Advisory to provide the following financial services to retail and wholesale clients.

4.2 General financial product advice. We are authorised to provide general financial product advice in relation to:

  • (a) basic deposit products; and
  • (b) non-cash payment products.

4.3 General advice is advice that does not take into account your personal objectives, financial situation or needs. We do not provide personal advice. If you need advice tailored to your personal circumstances, you should consult a licensed financial adviser.

4.4 Dealing in financial products. We are authorised to deal in basic deposit products and non-cash payment products by applying for, acquiring, varying or disposing of those products on behalf of our customers.

5. How we are remunerated

5.1 No fees charged to buyers or vendors. We do not charge buyers or vendors any fees for the Escrow Service or for the financial services described in this FSG.

5.2 Interest on funds held. We earn revenue by retaining the interest earned on funds held in the Escrow Bare Trust and in customer Virtual Accounts. We are entitled to retain this interest under the terms of the Escrow Deed and the Platform Agreement. This is how the service is funded.

5.3 Fees we pay MSC Advisory. We pay MSC Advisory a fee for our authorisation as their authorised representative. The fee is not based on the volume or value of the financial services we provide to customers.

5.4 Fees MSC Advisory pays us. MSC Advisory does not pay us any commission, fees or other remuneration for the financial services we provide under MSC Advisory's licence.

5.5 Other benefits. We do not pay or receive referral fees, commissions or other benefits in connection with the financial services described in this FSG, other than as disclosed above.

6. Associations and relationships

6.1 We are an authorised representative of MSC Advisory. Other than this relationship, we have no associations or relationships with product issuers or other financial services licensees that would reasonably be expected to influence the services we provide.

6.2 We use third-party service providers to operate the Platform, including a payment service provider that issues and operates the Virtual Account product. The identity of these service providers and the role they play is set out in the Platform Agreement.

7. Compensation arrangements

7.1 MSC Advisory holds professional indemnity insurance that satisfies the requirements of section 912B of the Corporations Act 2001 (Cth) for the financial services provided under its licence, including the services we provide as MSC Advisory's authorised representative.

7.2 We also maintain our own professional indemnity insurance appropriate to our role as an authorised representative.

7.3 This insurance covers claims in relation to the conduct of MSC Advisory's authorised representatives and their employees, including after they cease to be authorised, for matters that occurred while they were authorised.

8. Complaints and dispute resolution

8.1 If you are dissatisfied with a financial service provided to you by us, you can make a complaint and we will work with you to resolve it. Complaints are handled in accordance with MSC Advisory's Complaints and Dispute Resolution Policy, which complies with ASIC Regulatory Guide 271.

8.2 What is a complaint. A complaint is an expression of dissatisfaction made to or about us relating to our products, services, staff or complaints handling, where you expect a response or a resolution.

8.3 Step 1: Contact us. In the first instance, please contact us so we can try to resolve your complaint:

We will acknowledge your complaint within one business day of receipt.

8.4 Step 2: MSC Advisory. If your complaint is not resolved by us, or if you would prefer to raise it with the licensee directly, you can contact MSC Advisory's Compliance Team:

8.5 Response timeframes. We will provide a written response to your complaint within 30 calendar days. If your complaint is resolved to your satisfaction within five business days, a written response may not be issued.

8.6 If we cannot provide a response within 30 calendar days due to the complexity of the matter or circumstances beyond our control, we will write to you before that period expires explaining the reason for the delay and your right to take the complaint to AFCA.

8.7 Step 3: External dispute resolution (AFCA). If your complaint is not resolved to your satisfaction, or if we have not provided a response within 30 calendar days, you can refer it to the Australian Financial Complaints Authority (AFCA). AFCA provides free and independent dispute resolution for financial services.

9. Privacy

9.1 We collect, hold, use and disclose your personal information to provide our services to you. The way we handle your personal information is set out in the Platform Agreement and in our Privacy Policy, which is available at www.trustport.com/privacy-policy.

9.2 If you do not provide the personal information we ask for, we may not be able to provide our services to you or comply with our legal obligations, including under anti-money laundering and counter-terrorism financing laws.

10. Updates to this FSG

10.1 We may update this FSG from time to time. The current version is available on our website. If a change is materially adverse to you, we will notify you in accordance with the Platform Agreement.
